TERMS & CONDITIONS FIT 13
§1. ACCESSION TO THE AGREEMENT

These Regulations define the terms and obligations of the Clients of the FIT13 gym (hereinafter referred to as the “Gym”), owned by the sole proprietor FIT13 Roman Shmal, NIP: 5223087532, REGON: 525189502, Poland, 01-210 Warsaw, Kolejowa Street 47A/U10.

The Gym provides services in the field of physical activity for adults.

All clients may use the Gym’s services under the terms set out in these Regulations.

By booking and paying for the services, the Client agrees to the terms of these Regulations.
§2. TERMS OF SERVICE PROVISION

The Client is obliged to pay for a single entry or a training package in accordance with the current price list.

The transfer of a training package to third parties is prohibited.
-
The Client has the right to book training sessions or visits via Instagram (@fit13.warsaw) or directly with the trainer.

The training schedule is arranged individually with each Client.
-
The validity period of a training package is 40 days from the date of the first visit.
-
The Gym reserves the right to temporarily suspend operations due to renovations or maintenance, as well as to cancel individual training sessions.
§3. RULES OF GYM USE

The consumption of alcohol, smoking (including electronic cigarettes), and the use of any narcotic substances are prohibited on the premises of the Gym.

The use of indoor footwear is mandatory. Outerwear and shoes not intended for training must be left in the changing room.

It is recommended to wear comfortable sports clothing and to use personal exercise mats; however, the Gym also provides mats.

During training, the Client is obliged to follow the trainer’s instructions.

The Client must use the equipment only as intended and maintain order in the Gym.
-
The Client must arrive at the training session 10 minutes before it starts. In case of being late for more than 15 minutes, the trainer has the right to cancel the session.

In case of feeling unwell, sustaining an injury, or being pregnant, the Client must inform the trainer before the session begins. Participation in training sessions is at the Client’s own responsibility.

The Client is obliged to comply with the rules of conduct of the building in which the Gym is located.
§4. BOOKING, ABSENCE

To participate in classes, prior registration is required, including via Instagram @fit13.warsaw. Before the first session, the Client must inform about their health condition and lifestyle in order to ensure proper group placement.

The number of places in groups is limited.

To book or reschedule a session, it is necessary to provide full name, phone number, trainer’s name, and the date of the training.
-
A session may be canceled no later than 24 hours before it begins.
-
Timely notification of absence entitles the Client to reschedule the session within the validity of the current package.
-
Failure to notify of absence is considered as the session being used.
§5. PAYMENTS
-
Payment is made in advance – for the selected package or a single visit.
-
The Gym reserves the right to change the prices of services.
-
Payment can be made in cash, by bank card, or via bank transfer.
-

The Client has the right to cancel the package before the first session. After the first visit, refunds are not possible.
-
Entrepreneurs are obliged to inform about their status at the time of payment in order for the NIP number to be included on the fiscal receipt.
§6. GIFT CARDS (VOUCHERS)

To purchase an electronic voucher, contact the Gym via Instagram. After payment, the voucher is sent by email within 12 hours.

Vouchers cannot be exchanged for cash or other services.
-
The validity period is 3 months, with the possibility of a one-time extension of 1 month for an additional 350 PLN.
-
Vouchers are available in electronic or paper form.
-
Personalized vouchers may only be used by the person whose name is indicated on them.

Paper vouchers can be purchased directly at the FIT13 Gym at: Kolejowa Street 47A/U10, Warsaw.
§7. TERMINATION OF THE AGREEMENT AND COMPLAINTS

The Client may temporarily suspend a package due to illness by providing a medical certificate.

Notification of suspension must be sent no later than 7 days from the onset of the illness via e-mail to roma.shmal@gmail.com, through Instagram, or by post.

FIT13 does not refund payments if the reason for cancellation is related to the Client (e.g., a change in circumstances).

Complaints are accepted via email or at the Gym reception. A complaint must include:

personal data,
-
the subject of the complaint,
-
justification.

Complaints should be sent to: roma.shmal@gmail.com. FIT13 undertakes to review the complaint within 14 days.
-
In case of improperly submitted complaints, FIT13 may leave them without consideration.
-
The response to the complaint is sent by email to the address provided by the complainant.
-
If the complaint is upheld, the refund will be made within 14 days to the Client’s account.
§8. FINAL PROVISIONS

The provisions of these Regulations do not limit the rights of the Client provided by applicable law, including the Law of Ukraine “On Consumer Rights Protection.” In case of conflict, the law takes precedence.

If any provision is recognized as invalid or unenforceable, the other provisions remain in effect.

FIT13 may amend the Regulations, provided that Clients are notified in advance by publishing the updated PDF file on the website and Instagram. Changes take effect 14 days from the date of publication.

Before using the services, the Client is obliged to familiarize themselves with the Regulations.
-
The Client’s signature confirms that they have read, accept, and undertake to comply with the terms.

In the event of the instructor’s illness, the Gym reserves the right to appoint a substitute without prior notice.

The training schedule may change.
-
In all cases not regulated by these Regulations, the provisions of the Civil Code of Ukraine shall apply.

Each participant is obliged to comply with the Regulations. Violation of the rules may be grounds for immediate termination of the agreement without compensation. Ignorance of the Regulations does not exempt from the obligation to comply with them.
